Terms of Service

Welcome to VasiWill. These Terms of Service ("Terms") govern your access to and use of the digital estate planning platform available at vasiwill.ae (the "Platform"). These Terms constitute a binding legal agreement between you and DESCENTEK FZ LLC ("VasiWill", "we", "us", or "our").

By accessing or using the Platform, you expressly acknowledge and agree to these Terms.

VasiWill provides a self-help digital platform that enables users to create, store, and manage estate planning documents using automated tools and templates (the "Services").

2.1 Self-Help Platform

VasiWill is a technology platform, not a law firm. The Services are provided on a self-help basis only. We do not provide legal advice, legal opinions, or legal representation. The availability of jurisdiction-specific document templates (including for the United Arab Emirates) does not constitute the provision of legal advice or reserved legal services.

2.2 User Responsibilities

You are solely responsible for:

• The accuracy of the information you provide.
• Deciding whether the Services are appropriate for your needs.

2.3 Jurisdiction-Specific Services

Certain Services are designed to facilitate the creation of estate planning documents intended for use in the United Arab Emirates. Services relating to wills intended for registration or use in the UAE are facilitated by DESCENTEK FZ LLC.

To use the Services, you must register for an account. You agree to provide accurate and complete information and to keep your login credentials secure. You are responsible for all activities that occur under your account.

Our Services are currently designed for:

• Expatriates residing in or owning assets in the UAE.
• Users at least 21 years of age with the legal capacity to contract.

5.1 Pricing

We offer transparent, one-time pricing for our document packages. Current prices are displayed on the Platform at the time of purchase.

5.2 Payment Processing

All payments are securely processed through third-party PCI-DSS compliant payment processors (e.g., Stripe). By inputting your payment method, you authorise the processing of the transaction on behalf of DESCENTEK FZ LLC.

5.3 Refunds

Due to the digital nature of the Services, access to the documents is immediate. Therefore, all sales are final and non-refundable once payment is confirmed and access is granted.

5A.1 Overview

VasiWill Membership is an optional annual subscription that provides ongoing access to will updates and early access to new products such as Power of Attorney documents as they become available on the Platform.

5A.2 Billing & Renewal

Membership is billed as a single annual payment at the price displayed at checkout. Your membership will automatically renew each year on the anniversary of your original purchase. We will send you an email reminder before each renewal charge.

5A.3 Government Fees Excluded

Membership covers VasiWill platform fees only. Any government, court, or registration fees (including but not limited to DIFC or ADJD will registration fees) are not included and remain your responsibility.

5A.4 Cancellation

You may cancel your membership at any time by contacting info@vasiwill.ae. Cancellation takes effect at the end of your current billing period. No partial refunds are issued for unused time within a billing cycle.

5A.5 Changes to Membership

We reserve the right to modify membership pricing or included features. Any price changes will take effect at your next renewal and we will notify you by email at least 30 days in advance.

The Platform, including all code, content, visual interfaces, and document templates, is the exclusive property of DESCENTEK FZ LLC and is protected by international copyright and trademark laws.

License: We grant you a limited, non-exclusive, personal licence to use the Platform to create and store your own estate planning documents.

Restrictions: You may not copy, modify, distribute, sell, or reverse engineer any part of the Platform.

We take your privacy seriously. Your personal data is controlled by DESCENTEK FZ LLC in accordance with our Privacy Policy, available at vasiwill.ae.

We use bank-grade AES-256 encryption to protect your sensitive information. Full details of how we collect, use, and safeguard your data are set out in our Privacy Policy.

8.1 "As Is" Service

The Platform is provided "as is" without warranties of any kind. We do not guarantee that the Platform will be error-free or that the documents prepared will always be suitable for your specific legal needs.

8.2 Limitation of Liability

To the fullest extent permitted by law: (a) VasiWill shall not be liable for any indirect, consequential, or incidental damages, including loss of data or financial loss. (b) Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us for the Service.

9.1 Amicable Resolution

We prefer to resolve concerns directly and efficiently. Before filing a claim against VasiWill, you agree to try to resolve the dispute informally by contacting info@vasiwill.ae. We will attempt to resolve the dispute informally by contacting you via email. If a dispute is not resolved within thirty (30) days of submission, you or VasiWill may bring a formal proceeding.

9.2 Governing Law

These Terms and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the Federal Laws of the United Arab Emirates.

9.3 Jurisdiction

The parties hereby agree to opt-in to the jurisdiction of the Dubai International Financial Centre ("DIFC"). Any dispute, difference, controversy, or claim arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the Courts of the Dubai International Financial Centre (the "DIFC Courts").

9.4 Small Claims Tribunal

Notwithstanding Section 9.3, if the value of the claim is less than AED 500,000, the parties agree that the dispute shall be adjudicated exclusively by the Small Claims Tribunal (SCT) of the DIFC Courts. This ensures a faster, cost-effective resolution for consumer disputes.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on the Platform prior to the changes taking effect.

Your continued use of the Service after changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
